ODHISA TO GET - 'LEGISLATIVE COUNCIL'

WHAT JUST HAPPENED?

 Odhisa is all set to get a Legislative Council like several other states in the country.

A proposal in this regard was approved at a Cabinet meeting presided over by Chief Minister 'Naveen Patniak'.

 Now, voting will be done in this regard in the upcoming state monsoon session which is going to begin from September 4.

Below is the proposal:
  • The minister said that the proposed council will have 49 members , which is one-third of the 147 member state assembly.
  • The state will have to spend 35 Crore rs annually for the council, the members of which will get salary and allowance as given to the members of the Legislative council.
IS ODHISA GOVERNMENT TOOK THIS DECISION SUDDENLY?

 No, It took a while to take this decision of setting the 'Legislative Council'.
  • The Odhisa Government had setup a committee in 2015 to study the Legislative councils in other states and recommend for establishment of one in the state.
  • The committee visited four states -- Bihar, Telangana, Maharashtra & Karnataka for the purpose. It had submitted its report to the chief Minister on August 3 this year.[i.e. after 3 year study]
ABOUT VIDHAN PARISHAD OR LEGISLATIVE COUNCIL

 Article 169 of the Constitution of India provides for the establishment of a Vidhan Parishad. The Vidhan Parishad or Legislative Council is the upper house in those states of India that have a bicameral legislature. As of 2018, seven (7) (out of twenty-nine) states have a Legislative Council.They are elected by local bodies, legislative assembly, governor, graduates, teacher, etc. Odisha, too, is now all set to make a legislative council. And members are known as MLC. There is timing of 6 years of vidhan parishad.

Below seven states have Legislative council :-
  • Andhra Pradesh Legislative Council
  • Bihar Legislative Council
  • Jammu and Kashmir Legislative Council
  • Karnataka Legislative Council
  • Maharashtra Legislative Council
  • Telangana Legislative Council
  • Uttar Pradesh Legislative Council
Any State of India if they want can set up its - 'Vidhan Parishad' OR Legislative Council' under article 169.

Legislative council must not have more than 1/3rd of the total membership of the assembly of that state. .And minimum members must be 40

Member of Legislative council < 1/3 rd member of State Assembly.

 Example : State has 300 MLA Then Vidhan Parishad must have < 100 members

 Exception is of Jammy Kashmir where members in Legislative Council is 36.

 METHOD OF CREATION
  • In State assembly, they need to pass the proposal with a majority of 2/3rd via voting. So whether there should be a legislative council in the state or not, is decided by the legislative assembly of the state itself. But it does not mean Legislative assembly can itself create the Legislative council.
  • Then, after being passed from State Assembly, It go to Parliament. And Under Article 169 of the constitution, , parliament may by law create or abolish  the second chamber in a state if the Legislative assembly of the state passes a resolution to that effect by special majority.
PURPOSE OF VIDHAN PARISHAD

 To improve the decision making - Legislative Council is a good way.

 But there are so much dispute from decades on the Question of VIDHAN PARISHAD.

 As Many times, state setup its vidhan parishad and later on abolished by another government when they came in power. Hundreds of crore spent on it annually.
