BCCI UNDER RTI - IS IT THE RIGHT THING TO DO?

WHAT JUST HAPPENED ?

BCCI comes under RTI act.

The Board of Control for Cricket in India (BCCI) is now covered under the RTI Act and answerable to the people of the country under its mechanism, the Central Information Commission ruled recently.

The decision not taken by SC or High Court. The decision taken by Central Information Commission.(CIC)

CIC - Central Information Commission 

The Central Information Commission has been constituted with effect from 12-10-2005 under the Right to Information act 2005 (RTI)

POWERS OF CIC

The commission has certain powers and functions mentioned in section 18,19,20 and 25 of the RTI Act, 2005

If someone ask information from RTI and he/she did not get adequate information. So, person can came to CIC in second appeal for giving information.

They own-self ask any body to disclose the information (Suo moto disclosures).

If any department told someone that you can't file RTI in this department, Then that person can go to CIC to ask the reason why he/she can't file the RTI in that particular department.

All the decision of the Commission are final and binding. But anyone can challenge in High Court and SC. 

BCCI IS NOT HAPPY 

The BCCI has always held the opposite view : that it did not come under the ambit of RTI.

BCCI told that, we not even took money from Government, not any type of funding So we not came under RTI and we are autonomous.

Lodha Committee recommended that BCCI should come under RTI. This committee suggested if we need reform in BCCI, Then BCCI should come under RTI.
So that People got to know the selection process, IPL Franchise, IPL owners and Their Powers etc more information. 

BCCI had avoided taxes on its income, claiming exemption as a charitable organization. Although Income Tax Department withdrew this exemption in 2007-08.

CCI told, if you are autonomous then why you use stadium - In this Response BCCI announced that it will spend 1600 crore over the subsequent one year to upgrade the cricket stadium around the country. 

HOW IT HAPPENED ? 

The CCI Commission went through the law, Orders of Supreme Court, , The Law Commission of India report and found that BCCI can came under Section 2(h) of the RTI act.

DID CIC DID THIS OWN?

No, CCI did not took this decision owns-elf. 

Behind this, there is an RTI application filed by Geeta Rani and she asked the guidelines under which the BCCI has been representing India and selecting players of the country.

and Ministry of Youth Affairs and Sports did not respond well to application filed by Geeta Rani.

CIC commissioner informed  Ministry of Youth Affairs and Sports that with in 15 days, Prepare the Online and Offline mechanism of RTI application, so that you get well connected and response in timely manner

Along with this, CIC told that, Now BCCI should be listed as a NSF (National Sports Federation ) under the RTI act.

WILL BCCI AGREE WITH THIS? 


BCCI will go to High Court to challenge this decision given by CIC
