Waiver for India under CAATSA - S400 Missile Deal with Russia.

BACKGROUND

India wants to procure long range missile system to tighten its defence mechanism.
In 2016, India had signed agreement with Russia on Triumf Interceptor based missile system. OR S400 missile.

But , There has been mounting concerns in India over US sanctions against Russia defence under CAATSA Law.

WHAT is CAATSA LAW ?

Countering America's Adversaries through Sanctions Act (CAATSA) -Bill has been introduced in US Congress.

According to this CAATSA Law - Sanctions will be imposed on any country if they did trade in (Defence and Intelligence sectors) with  Iran, North Korea and Russia.

According to Section 231 of CAATSA, any country or entity that carries out “transactions with the intelligence or defence sectors” of the Russian government would face sanctions from the U.S.

With these the US also wants countries to knock the doors of USA rather than Russia.
  • It is a United States federal law that imposed sanctions on Iran, North Korea, and Russia
  • The CAATSA includes sanctions against countries that engage in significant transactions with the Russian defence and intelligence sectors.
Hence, India was worry as India wants to procure S400 Missile from Russia. 

Why USA always put sanctions - Simple Answer is this - U.S is powerful country. All Banking done in Dollar.

Russia is a Larger Exporter of Defence. So, when CAASTA came in scenario all buyers which Buy  Defence equipments from Russia, their tension increase, as  US may put Sanctions.

NOW WHAT HAPPEN - CHANGES IN CAASTA

The conference committee of the house and senate agreed on the final version of an annual defence policy bill, which would amend the dreaded Countering America's Adversaries through Sanctions Act (CAATSA).

This waiver will allow India to ink the Rs 39,000 crore deal ..
This waiver will allow India to ink the Rs 39000 crore deal for Five S400 Triumf air defence missile system from Russia.

This comes soon after defence minister 'Nirmala Sitharaman' on July 13 asserted India would go ahead with the S400 deal with Russia desipte pressure from US, dismissing CAASTA as a "US Law, not a UN Law".

As India always follow UN Law.



2+2 Meeting

India is going to host 2+2 Dialogue with United States in 2018 in New Delhi. In the inaugural meeting , Minister of External Affairs, 'Sushma Swaraj' and Defence Minister 'Nirmala Sitharaman' will host US Secretary of State Michael R. Pompeo and US Secretary of Defence James Mattis.

CAASTA will also figure in the inaugural 2+2 meeting.

This 2+2 meeting cancelled twice earlier.


WHAT ABOUT CHINA SANCTIONS - WHY WHY CHINA NOT INVOLVED IN ALL OF THIS?

China also purchases S400 from Russia. 
But, CAASTA act passed by US in 2017. But China has completed this deal with Russia before that. That's why CHINA not involved in this.


NOW - WHY U.S. GIVE WAIVER TO INDIA ?

U.S. is looking for Long Term Benefit. Because If U.S. Put sanctions on India, India may break all ties with U.S. and get completely dependent on Russia.
which will loose U.S. market.
